The FDA’s decision is one of several federal rules that make Viagra, which treats erectile dysfunction, not a prescription drug. But the FDA has not required the makers of these drugs to disclose their product information to the FDA.
Viagra was approved in 1998 and was first marketed by Pfizer as a treatment for erectile dysfunction in 1998, but the FDA has not approved Viagra’s use since 2011.
The decision by the FDA comes as the drug industry fights a growing number of lawsuits that claim the drugs were ineffective or harmful.
The lawsuits say the manufacturers marketed the drugs in ways that were not approved by the FDA and the FDA has not approved them. They claim that Pfizer’s Viagra, which was originally approved by the FDA in 1998, was too expensive and not approved by the FDA.
The manufacturers argue that they marketed the drugs in such a way that the FDA has approved and that the products’ labeling has not indicated the risks.
“This case is not one of the few cases that is of much relevance to the issue of drug manufacturers using their drugs to treat sexual dysfunction,” said Mark B. Allen, a partner with Allen & Hanover Development in Manhattan Beach. “This is another case in which a manufacturer should not be allowed to market a product that is not approved by the FDA.”
In addition to the lawsuit, Allen and Buserelle, a plaintiffs’ lawyer, say that the drugs’ labeling failed to clearly state that they work for erectile dysfunction. They also say that the makers of Viagra, which treats erectile dysfunction in men, have failed to adequately warn consumers of the risk of sexual dysfunction and that there’s little evidence the drug poses a greater risk than Viagra itself.
Allen says that he was not aware of any studies demonstrating that Viagra’s active ingredient, sildenafil citrate, is less effective than drugs like Adderall and Cialis. Instead, he says, he was unaware that Viagra’s active ingredient, tadalafil, is not FDA approved for the treatment of erectile dysfunction.
The judge ruled in favor of the plaintiffs. The case involved a Viagra company, Eli Lilly, which in 2005 had been ordered to pay $50 million to settle lawsuits alleging that the makers of Viagra promoted erectile dysfunction drugs that were not approved by the FDA.
The suit was filed by plaintiffs Michael E. Stoll, who is a plaintiff in a class action lawsuit against Pfizer, alleging that the drug companies failed to warn consumers of the risks of sexual dysfunction, and that the manufacturers of Viagra did not properly warn consumers of the risks of sexual dysfunction.
Stoll had sued Lilly and its employees for allegedly marketing Viagra for an unapproved purpose, but his case was eventually dismissed by the judge.
In a statement to the Times, Eli Lilly said: “This case is one of several that we have decided on its merits and the company has no right to have this case thrown out in the courts.”
In a statement to the Times, Lilly said the company is “continuing to defend its actions in this court case.”
The lawsuit filed by Lilly and its employees against the companies and the plaintiffs was brought under a common law of consumer fraud, which applies to consumer products. The lawsuit was based on a lawsuit filed by a consumer who alleged that the companies’ marketing of erectile dysfunction drugs caused him to suffer erectile dysfunction, which is why he is seeking damages.
“This case is a result of a violation of the statute of limitations, and it’s a victory for consumers,” said David A. Guglielmi, a partner at Michael Guglielmi & Associates in New York, who specializes in consumer-health litigation.
“The company has been accused of using the statute of limitations for a number of other matters. We are pleased to learn that we have been able to defend our actions to help consumers,” Guglielmi said.
